HIPAA

The Health Insurance Portability and Accountability Act (HIPAA) provides rights and protections to participants and beneficiaries in group health plans. As an employer, it’s important to understand how this legislation impacts your company.

You may already be familiar with one aspect of HIPAA, Protected Health Information (PHI), which restricts access of medical information to those who are authorized. Because The Greer Agency acts as your group health representative, we must have your permission before discussing specific claims with an insurance provider.

The basic premise of HIPAA allows an employee to have continuation of coverage. When an employee leaves a group health plan, a Certificate of Credible Coverage details the dates the employee was covered under the plan, which can be credited toward a pre-existing condition waiting period.

HIPAA also ensures that employees and their dependents are not discriminated against based on pre-existing medical conditions. There are also special circumstances – such as birth, marriage, adoption or the loss of other coverage – where an employee can enroll in a new plan outside an enrollment period.
